1. Introduction
The WE BUILD Portal (“Portal”) is a digital collaboration platform for members of the WE BUILD Consortium. The Portal is developed and hosted on Open Social. These Terms of Use define the rules for any natural or legal person who makes use of the platform (“User or Users”). By using the Portal, you agree to comply with these Terms of Use.
2. Use of the Portal
Use of the platform shall be limited to the performance of obligations under the Grant Agreement and the Consortium Agreement. Furthermore, the use of the platform is subject to the provisions contained in stated agreements, these Terms of Use, the WE BUILD Project Management Handbook, Use case/Work Package specific Data Management Plans (if applicable) and all other applicable laws and regulations.
More specific: Uploading and/or sharing of information
A specific form of use of the platform, the uploading and/or sharing of information by the User (including but not limited to data, documents, files, records, images, or any other materials, in whatever form or medium), requires specific attention and care of the User prior to sharing.
User should be aware that uploading and/or sharing information is subject to various provisions as stated in the Grant Agreement, the Consortium Agreement, these Terms of Use, the WE BUILD Project Management Handbook, Use case/Work Package specific Data Management Plans (if applicable), and all other applicable laws and regulations (which could include, if applicable, the General Data Protection Regulation, competition law, law concerning trade secrets and laws concerning intellectual property rights, etc).
Users (and thus not the Coordinator, Management Board, or the Lead of Work Package 1 of WE BUILD or other Use/Cases or Work Packages) are fully responsible for sharing, uploading and/or processing information they upload or share via the platform. Users should therefore under own responsibility perform a legal compliance review before uploading and/or sharing any information.
The general framework that applies for uploading and/or sharing information is just described. It includes, without limitation, the following.
Unless as explicitly stated otherwise in the WE BUILD Project Management Handbook or a Data Management Plan of a specific Use Case/Work Package, user is not allowed to upload and/or share:
- Information that has not undergone legal review prior to uploading or sharing, or where such review demonstrates that uploading and/or sharing would violate the framework described in these Terms of Use.
- Information that infringes copyright, trademarks, or third-party rights (e.g., Background Information as defined in the Grant Agreement and Consortium Agreement, or results of previous projects that are subject to the rights of third parties).
- Information that is classified as special category of personal data as referred to in provision 9 of the GDPR (personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person's sex life or sexual orientation);
- Datasets of any nature;
- Defamatory, discriminatory, racist, violent, or otherwise unlawful content;
- Other categories explicitly restricted by the WE BUILD Project Management Handbook.
3. User Responsibilities
- User should keep the account details secure and do not share (login) details.
- User is not allowed to view information that it not related to its Work Package or General Capability.
- User should use the Portal respectfully and professionally.
User should immediately report any misuse, suspected data breach, or policy violation.
4. Termination of Access
Access may be immediately blocked in the event of a breach of these terms or if there is any suspicion thereof.
5. Intellectual Property

7. Amendments
To the extent permitted under applicable laws and regulations, these Terms of Use may be amended unilaterally.
